The Draft Regulation of the Minister of Health Amending the Regulation on the Distribution of the Amount of Funds in 2023 Representing the Increase in the Total Budget for Reimbursement has been submitted for consultation.

The need for the amendment stems from the National Health Fund's proposed revision of the Fund's 2023 financial plan, assuming an increase in the total reimbursement budget resulting from the Fund's estimates, due to:
1) The pending agreement between the Minister of Health and the President of the Fund for financing from the Medical Fund for emergency access to drug technology services, the value of which is higher than originally planned;
2) the commencement of work on annexing the agreement entered into between the Minister of Health and the President of the Fund for the financing of services from the Medical Fund for the financing of drug technologies with high clinical value and drug technologies with a high level of innovation, the value of which was not known at the stage of estimating the total reimbursement budget for 2023;
3) by the Law of December 1, 2022, amending the Law on the Medical Fund and certain others (Journal of Laws of 2022, item 2674), which, among other things, increased the limit of funds from the Medical Fund to finance tasks included in the total reimbursement budget, such as emergency access to drug technologies and drug technologies with high clinical value and drug technologies with a high level of innovation;
4) the amount of funds included in the Medical Fund's financial plan for 2023 for the financing of drugs under emergency access to drug technologies, greater than originally projected by PLN 92,615,000, and for drug technologies with high clinical value and drug technologies with a high level of innovation, less than originally projected by PLN 21,057,000.
The Minister of Health is required by law, i.e. by Article 3(4) of the Law of May 12, 2011 on the Reimbursement of Drugs, Foodstuffs for Special Dietary Purposes and Medical Devices, to issue the regulation in question.
The recommended solution is to amend the regulation on the distribution of the amount of funds representing the increase in the total budget for reimbursement of drugs, foodstuffs for special nutritional purposes and medical devices, i.e. guaranteed benefits.
The only tool to achieve the purpose of the proposed regulation is to take a legislative initiative. It is not possible to achieve the expected effect through non-legislative measures.
As the total reimbursement budget increases, reimbursement outlays will increase, allowing patients to gradually increase access to guaranteed services
§ 1. In the Ordinance of the Minister of Health of December 12, 2022 on the distribution of the amount of funds in 2023 representing an increase in the total budget for reimbursement (Journal of Laws, item 2655), in § 2, the words "in the amount of PLN 817,132,000" shall be replaced by "in the amount of PLN 2,000,663,000".
