Settlements for "undue" refunds

The medical self-government, in response to the need to resolve the situation and bring about the withdrawal of penalties, developed a detailed expert analysis of the individual doctors' cases. Based on it, Health Minister Izabela Leszczyna recommended that the National Health Fund withdraw its claims in the case and begin settlement procedures with the doctors, who acted with good intentions, driven by the desire to save the health of young patients.
In order to take advantage of the possibility of settlement, physicians must make an appropriate application to the National Health Service. Some cases have already been resolved or are pending - three lawsuits have been withdrawn, two settlements have been scheduled for court, in one case a settlement was reached in court with a waiver of claims, and one person is awaiting a response from the NFZ on the settlement proposal. It is noteworthy that in one of the settlements, the suing party indicated - in accordance with the ministry's recommendation - that the doctor acted with good intentions for the benefit of the young patient, which contributed to the withdrawal of the lawsuit.
- The settlements are the result of joint action between doctors and the local government. This is the mission of the self-government - here are the resources to get expert support and reach out to decision-makers. Our meetings were, of course, about finding appropriate solutions for these doctors, but also about the current legal restrictions and the need to reorganize health care so that we as doctors can be guided by the good of patients. We are in constant contact with those whose cases are still being processed, but we believe that ultimately each of them will end in a settlement. We invariably stand by the position that by hitting the safety of the doctor you hit the safety of the patient," comments Maria Klosinska of the Supreme Chamber of Physicians, who is responsible in the local government for assisting physicians in the area under discussion.
At a recent meeting with wrongly punished doctors, President Lukasz Jankowski stressed that the NIL will continue to monitor the situation and support doctors in their next steps, providing due assistance at every stage of the proceedings.
