Compensation Fund passed by the Sejm. All Senate amendments rejected

During Friday's session of the Sejm, deputies rejected all of the Senate's amendments to the Law on Patients' Rights and Patients' Ombudsman. The law establishes a Medical Events Compensation Fund.

According to the adopted law, an out-of-court system for compensating damages for medical incidents is to be introduced. The system is to be operated by the Patient Ombudsman. A Medical Event Compensation Fund is also to be established.

The system, operating in this way, is expected to ensure a streamlined payment process. Events related to the provision of health care services in hospitals are to be covered. A claim for benefits will be able to be filed up to one year after learning of the event but no longer than three years after the event.

The benefit amount is a maximum of 200 thousand zlotys.
