The proposed ordinance replaces the ordinance of the Minister of Health and Social Welfare of July 12, 1996 on the list of entities authorized to conduct tests of materials and technological processes in order to determine the degree of their harmfulness to health and the scope of these tests (Journal of Laws, item 473 and of 2020, item 240).

The issuance of a new regulation is related to the need to introduce the current names of units authorized to test materials and technological processes in order to determine the degree of their harmfulness to health and the scope of these tests, and to verify the merits of keeping these units on the list.

In the case of the Central Institute for Labor Protection - National Research Institute, the scope of research assigned to the Institute was extended to include biological agents and the Institute of Occupational Medicine. prof. Jerzy Nofer in Łódź, the scope of research was extended to include biological factors. Within the structure of the Institute, there is the Laboratory of Biological Safety, which has in its scope of tasks the assessment of occupational exposure to biological agents and the estimation of occupational risk to these factors. The name of the Institute of Organic Industry in Warsaw was also updated, which since April 1, 2019 belongs to the Łukasiewicz Research Network and operates under the current name of the Łukasiewicz Research Network - Institute of Organic Industry. In addition, the existing Institute of Organic Industry, Branch in Pszczyna, also operates as a branch within the structure of the Łukasiewicz Research Network. In addition, the proposed regulation introduces a change in the legal basis for laboratories that have obtained accreditation or a certificate of conformity under the Act of 13 April 2016 on Conformity Assessment and Market Surveillance Systems (Journal of Laws of 2022, items 5 and 974) and the Act of August 30, 2002 on the conformity assessment system (Journal of Laws of 2021, item 1344 and of 2022, item 974). The remaining units authorized to test materials and technological processes in order to determine the degree of their harmfulness to health did not change the scope of the tests.
