The Draft Regulation of the Minister of Health Amending the Regulation on Conditions for Collection of Blood from Blood Donor Candidates and Blood Donors has been submitted for consultation.

In accordance with the statutory authorization set forth in Article 16 (7) of the Law of August 22, 1997 on the Public Blood Service, the Minister of Health establishes, among other things, the criteria for qualifying candidates for donors and donors of blood and blood components. In this regard, the problem of the limited number of personnel of public blood service units authorized to qualify and adjudicate the health status of candidates for blood donors or blood donors is resolved. In addition, the provisions for the qualification of donors by public blood service personnel are being detailed and simplified. The above is to contribute to the application of procedures based on the state of the art and in line with international recommendations of Directive 2004/33/EC of March 22, 2004 implementing Directive 2002/98/EC of the European Parliament and of the Council as regards certain technical requirements for blood and blood components (Official Journal of the EU L 91 of 30.03.2004, p. 272, as amended), hereinafter referred to as "Directive 2004/33/EC."

The recommended solution is to update the regulation and amend it to allow a nurse to qualify and adjudicate the health status of a candidate blood donor or blood donor (in accordance with the Law of March 9, 2023 on the National Oncology Network - Journal of Laws of 2023, item 650.) In addition, the rules for disqualification of blood donor candidates and the frequency of donation of blood and blood components will change . The draft regulation further specifies and clarifies the above-mentioned scope. The expected effect of the changes is to maintain the safety of blood and its components in relation to the latest scientific reports. Detailing and improving the clarity of the regulations will avoid different interpretations in the application of the regulations in individual units of the public blood service. Allowing nurses to qualify donors will also help to increase the possibility of donor qualification, in the case of a limited number of doctors, for example in field units or mobile blood collection campaigns. The remaining amendments are an update of the regulations with regard to the current state of knowledge and are aimed at improving comprehensibility, detailing the provisions and the principles and criteria to be followed by public blood service employees.
