The Draft Regulation of the Minister of Health amending the Regulation on the detailed scope of medical event data processed in the information system, as well as the manner and time limits for transferring such data to the Medical Information System has been submitted for consultation.

The proposed regulation is intended to change the rules for service providers to submit to the Medical Information System the data of a medical event in the field of pregnancy. It is proposed that the current obligation to provide the above information will become an action of the service provider only at the request of the recipient (patient). Significantly, at present, the submission of pregnancy information to the Medical Information System depends on the scope of the health service provided by the service provider, for the information in question must identify this service. Thus, once the proposed regulations enter into force, the possibility of reporting pregnancy data to the Medical Information System will depend on the simultaneous occurrence of two factors, i.e. it will be necessary:

1) the provision of a health care service to a recipient or the provision of a major medical procedure;

2) a statement (will/request) from the patient regarding the transfer of information regarding the pregnancy.

The information that the patient is pregnant is to draw attention to the need for appropriate care and diligence in the selection of proposed additional tests and ordered medications. However, the decision to provide data, according to the proposed regulation, is left to the patient (recipient) herself.

It is proposed that the provisions of the regulation enter into force on the day following the date of promulgation. It is worth emphasizing that the provision of health services is inseparable from the need to obtain patients' statements, among other things, regarding consent to the provision of services or access to medical records. Thus, the proposed regulations do not introduce new solutions, not previously functioning for service providers, while they are expected by recipients of services.
