It is up to the final decision of the pharmacist whether and how to perform the services, covered by the pilot program for reproductive health pharmacist services, consisting of:
- conducting an interview, in accordance with § 5(1) of the aforementioned regulation;
- issuing a prescription for a medicinal product that is a means of emergency contraception, as referred to in § 5(2) of the aforementioned regulation.
At the same time, the President of the National Health Fund informs that both the pharmacist's requirement of a minor patient to present the consent of the legal representative to provide the aforementioned services, as well as the pharmacist's refusal to provide services covered by the aforementioned pilot program to minor patients under 18 years of age, due to the lack of consent of the legal representative, will not constitute a violation of the rules of implementation of the aforementioned pilot program. pilot program, in particular, the aforementioned refusal will not be treated by the National Health Fund as "unjustified refusal to provide services to a patient entitled to a service provided by the pilot implementer under the contract", as referred to in § 5(3)(3) of the contract with the National Health Fund, and as a result - will not constitute grounds for imposing a contractual penalty.
