Due to the adoption by the Parliament of a law on free medicines for children and people 65+ and amendments to the reimbursement law, changes are needed regarding prescriptions.

New designations

A consequence of the described statutory changes is the need to introduce a new additional entitlement code in the regulation for patients who are the aforementioned recipients under the age of 18. According to the law, this will be the code "DZ". This corresponds to the proposed change in the proposed regulation.

With regard to the "S" code already specified in the amended regulation, referring to patients who are recipients, currently over 75 years of age (and ultimately 65 years of age), the draft appropriately modifies lp. 7 of the annex to the amended regulation so that the description of this entitlement correlates, by reference therein, with the provision of Article 43a(1) of the Act of August 27, 2004 on health care services financed from public funds (Journal of Laws of 2022, item 2561, as amended).

Restrictions

The amendment to the Reimbursement Law brings restrictions on prescriptions for medicinal products with the availability category "Rpw" and other dispensable medicinal products containing a narcotic or psychotropic substance in their composition from a pharmacy. Therefore, it is also necessary to remove from the amended regulation the provisions relating to prescriptions issued for the above-mentioned medicinal products in paper form, except in cases where such a prescription is issued by a veterinarian.
