What's next for Lex Kaczyński? Today, the Health Committee resumes its deliberations

Contrary to announcements, on Monday the Health Committee did not conduct the first reading of Lex Kaczyński, i.e. the draft law on employee testing, submitted by Law and Justice MPs. The fate of the project, one of the applicants of which is the president of Law and Justice, hangs in the balance.

The Health Commission was to start work at 4 p.m. Several dozen minutes earlier, the Ministry of Health announced on Twitter that Deputy Minister Waldemar Kraska and three SOP officers protecting Minister Adam Niedzielski were infected with SARS-CoV-2, therefore the entire management of the ministry will isolate itself. Apparently, the chairman of the Health Committee did not know about it, because just before the meeting he was trying to determine who would represent the government. The isolation, however, was so consistent that Tomasz Latos first postponed the meeting by an hour, and then had to start it without government representatives. This sparked protests from opposition MPs who, as they admitted, were eager to submit a motion to reject the bill at first reading.

Before this could happen, however, requests to postpone the meeting until Tuesday were submitted - first until the morning hours (10.00 am, the request was lost), and then by 3.00 pm - the motion submitted by the deputy chairman of the Committee, Rajmund Miller (KO), passed with one vote. The MP who tipped the scales was Andrzej Sośnierz (near Polskie Sprawy).

Declarations made by politicians from various clubs indicate that even if the Health Committee will finally hold its first reading and prepare a report recommending the continuation of the work to the Sejm, the adoption of the law in the Sejm is under a huge question mark, and to put it simply - it is unlikely. Voting against is announced by the entire opposition (although not necessarily for the same reasons), opposition is declared by MPs from Solidarity Poland and some PiS MPs (including Anna Siarkowska, leader of the group reluctant to vaccination and pandemic restrictions, who informed in social media about submitting a request for a public hearing project) and Paweł Kukiz and his two deputies.

Interestingly, also MPs supporting the project - incl. the chairman and vice-chairman of the Health Committee, Tomasz Latos and Bolesław Piecha - on Monday spoke of the need to introduce numerous amendments to it, on which MP Paweł Rychlik representing the applicants is working.

The beginning of Tuesday's session of the Sejm is scheduled for 4:00 p.m. So far, there is no information about the time shift, in theory it is possible to change the order of points (apart from work on the testing project, the Sejm is to listen to the government's information on the situation of the elderly), so that the commission has more time to work. Considering pure politics, PiS should withdraw from work on the draft in order to minimize image losses. If the Sejm rejects the bill signed by the PiS president, it will be a real political slap, as Jarosław Kaczyński avoids acting as the applicant. It is difficult to imagine a scenario in which an illogical act full of legal absurdities is passed.
