- Certain issues enshrined in the law raise many doubts. This is especially true of the reimbursement of OTC drugs and the provision for sharing deficits among 10 wholesalers," said the chairwoman of the Senate health committee, Beata Małecka-Libera.
However, the unconstitutionality of some provisions was pointed out by the Senate Legislative Bureau. This includes the introduction of an auto-amendment regarding the setting of funding limits per unit of pharmaceutical raw material used to make a prescription drug.
The Senate Legislative Bureau is of the opinion that the bill should be resubmitted to the chambers of commerce, the Social Dialogue Council, as well as employers' organizations and trade union organizations.
However, the pharmacists' self-government expressed support for the law. As Elżbieta Piotrowska-Rutkowska, president of the Supreme Pharmaceutical Council, said, the law contains very important provisions for the pharmacy sector. This is, for example, the regulation of pharmacy margins, unchanged since 2012. In addition, the law also regulates the issue of vaccinations carried out in pharmacies.
In the end, four members of the Senate Health Committee voted against DNUR. Now the bill to amend the law will go to the Diet. The next session is scheduled for July 28.
