Are policymakers backing off from tightening penalties for inadvertent medical errors? NIL does not hide its satisfaction after the Extraordinary Committee for the Amendment of the Criminal Law passed - contrary to the position of the Ministry of Justice - an amendment withdrawing from the tightening of criminal liability for Art. 155 (manslaughter). The amendment was proposed by MP Bartłomiej Dorywalski (PiS) and KO MPs (including Tadeusz Zwiefka). Nobody voted against this amendment, only 2 members abstained.

The draft provision, meaning for doctors an increase in the risk of absolute imprisonment for an unintentional medical error, was strongly opposed by the community. The medical self-government emphasizes that the non-tightening of the Criminal Code (with the invariably existing civil and professional liability of doctors) is a good prognosis in the context of the introduction of a system based on treatment safety postulated by doctors, focusing on a fast path of compensation for the patient and identifying and eliminating errors in the future. A tightening of the Criminal Code would impose additional pressure on the phenomenon of emergency medicine and marginalize the issue of quality in healthcare.
