Administrative proceedings have been initiated against the Municipal Police Chief in Krakow over a violation of personal data protection involving the release of an individual's personal data in a press release, the President of the Office for Personal Data Protection informed the RPO.

It concerns police intervention against a woman in a Krakow hospital. UODO President Miroslaw Wróblewski investigated a personal data protection violation involving the disclosure of sensitive information about an individual in a press release from the Krakow Municipal Police Station. In the course of the investigation, findings were made that determined the President of the UODO to initiate administrative proceedings against the Municipal Police Chief in Krakow, who was the controller of the disclosed data.

The investigation concerns the issue of the Commander's violation of, among other things:

  • principles of data processing in accordance with the law;
  • Principles for ensuring adequate security for the data;
  • and the processing and disclosure of data without a legal basis.

The President of the DPA informed the Ombudsman of the initiation of the proceedings, who in letters to the supervisory body showed interest in the DPA's actions in the case.
