The need to introduce changes to the regulation of the Minister of Health of 19 June 2019 on guaranteed benefits in the field of psychiatric care and addiction treatment (Journal of Laws, item 1285, as amended) is related to the implementation of the care reform psychiatric services for children and adolescents and is aimed at removing inaccuracies, clarifying the provisions, taking into account the postulates of experts cooperating with the Ministry of Health and results from the entry into force on April 6, 2022 of the Regulation of the Minister of Health of March 30, 2022 amending the regulation on specialization in areas applicable in health care (Journal of Laws, item 744), which introduced a new specialization in the field of addiction psychotherapy. It is also necessary to clarify the provisions relating to the provision of services for people with autism.

Taking into account the scope of knowledge and skills of specialists in the field of addiction psychotherapy, the regulation must be supplemented with persons undergoing specialist training and holding the title of specialist in this field.
Bearing in mind the above, the draft regulation proposes to update the definition of the terms of an addiction therapy instructor, a person applying for a certificate of addiction therapy instructor, a person applying for a certificate of addiction psychotherapy specialist, addiction psychotherapy specialist and adding a definition of a person who specializes in addiction psychotherapy.
As a consequence of the above, appropriate amendments to Annexes 2, 5 and 7 to the Regulation were proposed.
The definition of a community meeting was added and the list of benefits described in § 3 was extended to include the benefits described in Annex 8 to the regulation.
The project also introduces changes to the rules of providing services for people with autism. The changes are aimed at clarifying the conditions for the provision of services and thus enabling their proper valuation.
The proposed new wording of Annex 8 to the Regulation introduces changes to the conditions to be met by health care providers providing guaranteed benefits in the field of psychiatric care for children and adolescents within the reference levels. The introduced modifications relate primarily to the requirements for the conditions for the implementation of services guaranteed in the personnel part and the organization of the provision of services.
