The Draft Regulation of the Minister of Health on the cancellation of an epidemic emergency in the territory of the Republic of Poland has been submitted for consultation.

The cancellation of the state of epidemic emergency in Poland is justified by the request of the Chief Sanitary Inspector submitted to the Minister of Health on April 20, 2023, in which the GIS requests the cancellation of this state, in view of the current epidemiological situation, especially taking into account the decrease in the number of diagnosed SARS-CoV-2 infections, as well as the decrease in the number of deaths and hospitalizations observed recently. In view of the above proposal, it is considered reasonable to revoke the epidemic emergency.
The proposed regulation provides for the revocation of the state of epidemic emergency introduced as of May 16, 2022, based on the Order of the Minister of Health of May 12, 2022, on the declaration of a state of epidemic emergency in the territory of the Republic of Poland (Journal of Laws, item 1028). According to the draft, the revocation of the state of epidemic emergency is to take place on July 1, 2023.
Recall what is the difference between an epidemic emergency and an epidemic state? According to the Law of December 5, 2008 on the prevention and control of infections and infectious diseases in humans (i.e. Dz. U. of 2019, item 1239, as amended, hereinafter: the "Law on Control of Infectious Diseases"):
- An epidemic emergency is a legal situation introduced in an area due to the risk of an epidemic in order to take the preventive measures specified by law;
- A state of epidemic, on the other hand, is a legal situation introduced in an area in connection with an epidemic in order to take the anti-epidemic and preventive measures specified by law to minimize the effects of the epidemic.
