Limits for doctors on e-prescriptions. Ombudsman's office writes to health ministry

According to a letter sent by the Ombudsman's Office to Michal Dzięgielewski, director of the Department of Medical Treatment at the Ministry of Health, the Ombudsman received information about the e-Health Center's introduction of limits on the issuance of e-prescriptions by doctors.
"According to the information, the restrictions have been in effect since July 3, and consist of interference with doctors' right to practice their profession. This is because they introduce a ban on doctors issuing more than 300 prescriptions in ten working hours. This could lead to a restriction of patients' rights to health services," the letter reads.
As Piotr Mierzejewski, director of the Administrative and Economic Law Team at the RPO's Office, adds, concerns are being formulated in the public space about the hypothetical situation when more than 300 patients needing prescription medications will report to dispensaries. At the same time, a draft regulation on this issue has not been published.
In this regard, the team's director is asking the Ministry of Health for a position, and in particular to indicate the legal basis for the limits introduced on the issuance of e-prescriptions by doctors.
