The amendment of the Regulation of the Minister of Health of June 27, 2019 on the hospital emergency department (Journal of Laws of 2023, item 1225 and 1237), hereinafter referred to as the "ED Regulation", is aimed at enabling health care entities to comply with the requirements set forth in this regulation with regard to the organization in the location of the hospital emergency department, the place where night and holiday health care services are provided.

According to Section 15(4a) of the SOR regulation, there is an obligation to meet the requirement for the location of night and holiday healthcare services until December 31, 2023.

There are currently 246 EDs in the country, 20 of which declare that they will not provide night and holiday healthcare services at ED locations as of January 1, 2024.

The bill in question extends the period for bringing the ED into compliance with the requirements of the ED regulation regarding the organization at the hospital's location of a place for providing night and holiday healthcare services. The deadline for meeting the condition in terms of organization at the ED location of the place of providing night and holiday healthcare services will be postponed by 12 months (until December 31, 2024).

The aforementioned change will enable all hospitals with EDs to continue implementing the contract concluded with the provincial branch of the National Health Fund and allow them to complete the activities they have started.
