The Draft Regulation of the Minister of Health on Enriching Substances Added to Food has been submitted for consultation.

The purpose of the proposed regulation is to maintain measures to ensure the prevention and compensation of deficiencies in one or more nutrients in the Polish population.

Accordingly, the draft regulation specifies foods to which vitamins or minerals are mandatorily added and their maximum levels.

According to the proposed regulation, this will be cooking salt and fats as referred to in Regulation (EU) No. 1308/2013 of the European Parliament and of the Council of December 17, 2013 establishing a common organization of the markets in agricultural products and repealing Council Regulations (EEC) No. 922/72, (EEC) No. 234/79, (EC) No. 1037/2001 and (EC) No. 1234/2007 (OJ. Official Journal of the EU L 347, 20.12.2013, p. 671, as amended), excluding milk fats (butter, three-quarter-fat butter, half-fat butter, dairy spreads) as defined in point A of Appendix II "Spreadable fats" to Annex VII of that regulation. Mandatory iodization of table salt has been carried out since 1996 and has led to increased iodine intake at the population level and an associated decrease in iodine deficiency diseases, which has been highly appreciated by the International Commission for the Control of Iodine Deficiency Disorders and other international institutions.

In addition, the proposed regulation establishes in an annex a list of substances other than vitamins and minerals prohibited in the production of foodstuffs due to the need to ensure the health safety of consumers. The list of substances found to have harmful effects on health is contained in Part A of Annex III to Regulation No. 1925/2006. Such substances are banned from being added to food or used in food production. Regulation No. 1925/2006, in Article 11(2), allows national legislation to prohibit the use of substances other than vitamins or minerals in food.

LIST OF SUBSTANCES OTHER THAN VITAMINS AND MINERALS FORBIDDEN IN THE PRODUCTION OF FOOD PRODUCTS 1) yohimbine hydrochloride and the yohimbine group; 2) DMAA (specifically defined as: (a) 1,3-DMAA, (b) 1,3-dimethylamylamine, (c) 1,3-dimethylpentylamine, (d) 2-amino-4-methylhexane, (e) 2-hexanamine, (f) 4-methyl-(9CI), (g) 4-methyl-2-hexanamine, (h) 4-methyl-2-hexylamine, (i) dimethylamylamine, (j) geranamine, (k) methylhexanamine, (l) methylhexanamine; 3) evodiamine; 4) a group of selective androgen receptor modulators (SARMs), including: (a) andarine, (b) ligandrol, (c) ostarine, (d) Rad-140; (5) hygenamine; (6) hordenine; (7) ibutamorene; (8) pancreatin; (9) methystine pepper (Piper methysticum); (10) scabies (Mucuna pruriens).
