Are refugees from Ukraine entitled to free medicine? RPO asks MZ

The RPO has received a complaint from the Healthcare Employers' Agreement regarding doubts in interpreting the regulations raised by healthcare providers regarding the coverage of Ukrainian citizens in the right to free medicines granted to recipients under the age of 18 and over the age of 65.

According to the Healthcare Employers' Agreement, refugees from Ukraine under the age of 18 and over the age of 65 are entitled to free medicines for healthcare providers. However, there are doubts among healthcare providers about the interpretation of the regulations on the issue.

According to Article 37 (1) of the Law of March 12, 2022 on Assistance to Citizens of Ukraine in Connection with Armed Conflict on the Territory of Ukraine, a citizen of Ukraine whose stay in Poland is legal under Article 2 (1) of this law is entitled to medical care provided on the territory of Poland covering health care services on the terms and to the extent to which persons covered by compulsory or voluntary health insurance are entitled to benefits under the Law of August 27, 2004. on health care services financed from public funds - with the exception of spa treatment and spa rehabilitation - as well as the administration of medicinal products issued to recipients under the MZ health policy programs.

Therefore, BRPO Administrative and Economic Law Team Director Piotr Mierzejewski is asking the Director of the Department of Drug Policy and Pharmacy at the Ministry of Health, Lukasz Szmulski, for his position on the matter.
