Mandatory liability insurance for laboratory diagnosticians. Changes

The Draft Regulation of the Minister of Finance amending the Regulation on Compulsory Civil Liability Insurance of the Entity Performing Medical Activities has been submitted for consultation.

In connection with the new regulations introduced in the Law on Medical Activity with regard to the activities of laboratory diagnosticians, it is necessary to amend the Regulation of the Minister of Finance on compulsory insurance of civil liability of the entity performing medical activity. The amendments in question concern the determination of the amount of the minimum guarantee sum of this insurance with respect to laboratory diagnosticians.

Standards relating to laboratory diagnosticians in terms of the amount of the minimum guarantee sum in compulsory liability insurance will be introduced into the current regulations .

According to the Health Ministry's proposal, the amount of the minimum sum assured for laboratory diagnosticians who will carry out therapeutic activity in the form of professional practice has been adopted at levels analogous to the minimum sum assured provided for nurses and physiotherapists. Taking into account the forms of activity provided for by the Law on Medical Activity for laboratory diagnosticians, the minimum guarantee sum will be 30,000 euros for one event and 150,000 euros for all events whose consequences are covered by the liability insurance contract. It should be mentioned that the amount of the minimum guarantee sum should be "balanced" so as to ensure, on the one hand, adequate insurance protection for potential victims, and, on the other hand, not to overburden those subject to the insurance obligation and ensure the proper performance of the insured activity. At the same time, it should be emphasized that the guarantee sums contained in the draft were set at a "minimum" level. Bearing the above in mind and the fact that the above-mentioned entities are professional entities, in the case of potential performance of high-risk medical activities, those obliged to conclude an insurance contract should always conclude an insurance contract with a higher guarantee sum, which will be adequate to the potential risk.
