Protecting the rights of patients in psychiatric hospitals is a task of the Patient Ombudsman, which is carried out in particular with the help of the Psychiatric Hospital Patient Ombudsmen.
The Psychiatric Hospital Patient Ombudsman, when performing his tasks, has the authority to:
- access to all premises of the psychiatric hospital related to the provision of health services;
- access to the patient's medical records, without obtaining the patient's separate consent;
- processing of data captured by means of monitoring in rooms where patients are kept in isolation;
- communicate with patients, their legal representatives, legal guardians or actual guardians, in private, without the participation of others;
- to apply to the personnel of the medical entity, as defined in the law on medical activity, in particular to the attending physician, the head of the psychiatric ward (the physician in charge of the ward) or the head of the medical entity, and to the forming entity, as defined in this law, to take action to eliminate the cause of the complaint or the violations that have occurred.
