POZ: Service providers and the National Health Fund remain with theirs

The Federation of Healthcare Employers' Associations "Zielona Góra Agreement" sent a statement to the President of the National Health Fund and the Minister of Health. It is about annexes to contracts for the provision of benefits.

The service providers have accepted the content of the annexes, with the exception of the agreement regarding the period of notice. The vast majority of FPZ members believe that the current agreement, the 45-day notice period, is more advantageous than the provision proposed by the National Health Fund - a 3-month notice period.

Individual branches of the National Health Fund did not accept the annexes submitted to them, generating new ones, again with a 3-month notice period. We publish the content of the statement:


"Our members, in connection with the submission by individual branches of the National Health Fund, proposals of annexes to contracts for the provision of benefits (in view of the entry into force of the ordinance No. 79/2022/DSOZ of the President of the National Health Fund on the conditions for the conclusion and implementation of contracts for the provision of healthcare services such as primary care health), they returned the signed annexes, accepting their content - with the exception of the provision of the contract regarding the period of notice, as the vast majority of our members believe that the existing provision of the contract (45-day notice period) is more favorable than the provision proposed by the National Health Fund (3-month period of notice). notice)

However, individual branches of the National Health Fund did not accept the annexes submitted to them, generating new ones (again with a 3-month notice period) - again demanding their signing.

We cannot consider that it is justified to generate new annexes and refuse to accept annexes that leave the existing provision for a 45-day notice period. Therefore, on behalf of our members, we maintain our readiness to adopt the provisions of the ordinance No. 79/2022/DSOZ (as amended by ordinances No. 93/2022/DSOZ and 96/2022/DSOZ) - with the exception referred to above. Since the parties to the contract (the National Health Fund and individual service providers) have just agreed a 45-day notice period, the proposal to change this period to a 3-month period does not have to be accepted by our members.

In view of the above, we demand that individual branches of the National Health Fund be provided with instructions regarding the acceptance for use and recognition as binding of the annexes provided by our members. "
