On January 1, 2024, the preceding decree of the Minister of Health dated July 23, 2021 on the model of death card (Journal of Laws item 1448 and 2022 item 2839,in which the model of the card is specified, will expire, so it is necessary to determine a new model of death card.

It follows from the wording of the authorization that the model death card specified in the draft regulation should take into account the possibility of its preparation also in the form of an electronic document. Taking into account that documents drawn up in the form of electronic documents should, in terms of their information scope, be consistent with the models set out in the law, the death card includes information that will allow to maintain a uniform information scope, regardless of the form in which the card will be drawn up. Thus, the scope of data indicated for filling in the death card will allow it to be drawn up in both forms, i.e. paper with a handwritten signature or electronic in the form of an electronic document authenticated with a secure electronic signature verified with a valid qualified certificate of the person drawing up the death card.

From the existing "Part for registration of death" and "Part for cemetery administration," a "Part for public statistics" was separated, in accordance with the statutory authorization contained in Article 11, paragraph 4c in conjunction with paragraph 3d of the Law of January 31, 1959 on cemeteries and burial of the dead, containing: 1) the place of residence of the deceased, including the period of residence in the territory of the Republic of Poland in the area of a given municipality, if known; 2) the education of the deceased; 3) information about the death, including the cause of death, and the person stating the cause of death, and in the case of a child under one year of age: a) the time of birth, b) information about his health: length, weight, points on the Apgar scale, c) information about pregnancy and childbirth: duration of pregnancy, multiple births, number of children born to the mother. It should be noted that the scope of data covered by the current authorization coincides for the most part with the existing scope of data under Article 144(3) of the Law of November 28, 2014. - Law on Civil Status Records. At the same time, the draft indicates that death cards issued before the date of entry into force of the regulation will remain valid. The ordinance will enter into force on January 1, 2024. The draft ordinance does not contain technical regulations within the meaning of the provisions of the Decree of the Council of Ministers of December 23, 2002 on the functioning of the national system of notification of norms and legal acts (Journal of Laws, item 2039 and of 2004, item 597), and is therefore not subject to notification. The draft regulation does not introduce new solutions in relation to those currently in force that would affect the micro, small and medium-sized enterprise sector. The draft regulation is not subject to submission to the competent authorities and institutions of the European Union, including the European Central Bank, for opinion, notification, consultation or agreement.
